We at McMillan & Sobel take pride in our skills as civil litigators. We know where the courthouses are – and what to do when we get there.

Other than litigation for our business clients (discussed separately as “Business Litigation” in our practice areas), we have a wealth of experience in the following kinds of civil lawsuits:

  • Plaintiff’s Personal Injury
  • Plaintiff’s Medical Malpractice
  • Eminent Domain
  • Real Estate Title and Boundary Disputes
  • Claims for or against Decedent’s Estates
  • Claims for or against Trusts
  • Defense of professionals in “excess” Malpractice or Negligence Claims
  • Protection of Intellectual Property
  • Challenges to Municipal Ordinances/State Agency Actions

No list of these matters can ever be complete, because the kinds of civil cases in which our clients become involved are as varied as our client base.

While the subject matter of each civil case may vary, the skills and talent that we bring to these cases are consistently applied for the benefit of our clients. We have been representing clients in civil matters for as long as we have been practicing law. Cumulatively, we have appeared before almost every Judge in the county court systems for Cuyahoga, Lorain, Medina, Summit, Stark, Geauga, and Lake Counties in Northeast Ohio. We have also appeared before most of the federal judges and federal magistrate judges in the United States District Court for the Northern District of Ohio, Cleveland, Akron and Youngstown branches.

Preparation is the key to a successful outcome in any litigated civil case, regardless of whether the outcome is a negotiated settlement or jury verdict. We are engaged in the preparation of civil cases for trial literally every day of our professional lives. We have attended/conducted thousands of depositions and are constantly engaged in formal evidence gathering activities through the discovery process under the Ohio and Federal Rules that govern civil cases. We have worked with, prepared, and cross-examined experts in virtually every professional field – including medical; accounting; engineering; vocational rehabilitation; business and property valuation; and accident reconstruction, to name but a few. In short, we know how to prepare your case, and it is that preparation that leads to the results in civil cases that causes our clients to be our best source of referrals of new business.

While we are comfortable in the courtroom, we also understand the risk of litigation. We find that the risks can be better managed when a consistent and thoughtful strategy is applied in all of our civil cases. We pride ourselves in taking the time to simply think – and strategize – about each of our civil litigation cases. This often leads to the conclusion that our client’s best interest is not to bear the risk of a litigated result, but instead to resolve the litigation through alternate dispute resolution mechanisms. We are familiar with and have participated in hundreds of arbitrations and mediations that have resolved civil disputes and thereby avoided the inherent risk of trial for our clients.

If you are involved in a lawsuit – as either a Plaintiff or Defendant; if you have been injured in an accident or as the result of professional negligence; or if you are involved in any situation which may result in litigation, contact us and let us apply our civil litigation skills on your behalf.
